Independent Contractor Relationship: Contracting agent acknowledges that Tennessee Transactions is working for the agent under an independent contractor relationship with respect to all services rendered.
Scope and Limitations of Service: The scope and role of Tennessee Transactions duties are expressly limited to those of a transaction coordinator performing in an administrative, non-licensed capacity for the contracting agent.
Disclosure: The owner and manager of Tennessee Transactions is a licensed real estate affiliate broker in the state of Tennessee. Tennessee Transactions’ scope of service is strictly limited to those activities of a non-licensee and agency relationship is not formed nor fiduciary duties owed to any party to the transaction. The services provided by the Tennessee Transactions, are not intended to replace or substitute the duties or responsibilities the contracting agent has towards his/her clients (seller/purchaser) in the transaction.
Security: We use good-faith efforts to maintain physical, electronic and procedural safeguards to guard your non-public personal information. However, while we strive to protect your personal information, we do not ensure or warrant the security of any information you transmit to us, and you do so at your risk.
Indemnity: You agree to indemnify, defend and hold harmless Tennessee Transactions, its directors, officers, managers, employees, consultants, agents, and affiliates, from any and all third-party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of this Website and services or your breach of the Terms of Service. The company reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site. If there are any changes in how we use our site customers' Personally Identifiable Information, notification by email or postal mail will be made to those affected by the change. Payment Terms: In consideration for services provided, contracting agent agrees to pay Tennessee Transactions for services rendered at rate posted on www.TNTransactions.com. Tennessee Transactions will give contracting agent 30 days written notice of any price changes and those price changes will not be in effect for any transaction files submitted prior to the rate change date. Contracting agent will be invoiced for service in advance of closing date stipulated in the purchase agreement. Payment may be made by credit card though a QuickBooks Invoice or by check from the title company if allowed. If contracting agent’s broker authorizes payment at closing, the contract agent’s brokerage or settlement agent will make payment via electronic bank transfer to Tennessee Transactions at closing. Payment is due in full within 5 business days of file closing date. Regardless of any agreement made between contracting agent and their client for payment of our fees, contracting agent is ultimately responsible to satisfy any balance due to Tennessee Transactions upon closing of invoiced file.
Cancellation Policy: If Tennessee Transactions receives a copy of a fully executed cancellation of the purchase and sale agreement on a submitted file there will BE NO CHARGE due on that file.
